Illegal Move Time Penalty

11D1. Illegal move in time pressure.
Time pressure is defined as a situation where either player has less than five minutes left in a time control and the time control does not include an increment or delay of 30 seconds or more.

A director should not call attention to illegal moves in time pressure, only the players may make that claim. If, during the game, in time pressure, a player’s claim that one of either player’s last two moves was illegal is upheld by the TD, the position shall be reinstated to what it was before the illegal move and the procedure in rule 11A shall be followed, with no adjustment to the time on the clocks.

The above was passed by the delegates in 2016.

My question regards the final sentence that states: “with no adjustment to the time on the clocks”. Does this mean that illegal move time penalties (adding 2 minutes to opponent’s time) are not given, or does it mean that the players do not recover the time elapsed after the illegal move?

Yes, and also for 11H, which states that “[t]he time on the clocks shall not be adjusted; …”

Better wording would have been something like “the elapsed time is not reinstated”, although I would consider attempts to argue that a two-minute penalty should not be imposed based on this wording to be an attempt at “rules lawyering.”

Thanks, Ken. I wouldn’t consider myself a rules lawyer, I was just wanting to be sure I understood the intent. It would probably be wise to clarify that in at least a TD Tip.

I agree wholeheartedly about clarifying the wording at least in a TD tip. Lord knows there are enough rules lawyers out there!
