Having lost all court cases trying to prevent independent broadcasters from doing live move transmission from FIDE events, the friendly folks at FIDE have come up with another approach: blacklisting such broadcasters for up to 10 years. Since they can’t punish these web sites directly (having lost in court), they have adopted a policy under which any “member of the FIDE family” who cooperates with them (such as GM commentators/annotators) will be considered in violation of the FIDE Code of Ethics.
ICC is doing live move broadcast of the current FIDE Grand Prix tournament. So is at least one other source I found. So, apparently FIDE will blacklist these sites and then punish with an ethics charge any titled player who ever again assists them with broadcast commentary.
Easy fix. The websites will hire commentators who are retired from the game. In the alternative, they could select commentators tied to the Russian Federation and Vladimir Putin. The oligarchs can make or break FIDE, just as always.
In the EU there are serious consequences for taking actions which prevent a citizen from earning a living. This will likely be resolved in courts other than with CAS arbitration. As for the US, legal action could take a number of different avenues. There is nothing unethical with relaying chess moves or commenting on them. What FIDE is engaging in is tortious interference with commentator contracts. FIDE is potentially liable not only for actual damages, but they will likely be liable for punitive damages.
